Returns, Refunds and Cancellations Policy

Effective date: 27 October 2026

1. Who this policy applies to

This policy covers self-paced online courses purchased directly from Atamelang Training Academy (Pty) Ltd, trading as ATA Training Academy (ATA): an individual skill, a five-skill stage, or the complete 15-skill Employability Method. It does not set cancellation terms for workshops, facilitated training or separately contracted programme services.

ATA’s registration number is 2018/463212/07. Our address is 33 Brandt Street, Andrew Gouws Building, Kroonstad, 9500. Our website is www.atatrainingacademy.co.za. Read this policy with our Website Terms and Conditions and Shop and Fulfilment Policy.

2. Your rights and digital returns

Online learning cannot be physically returned. This does not remove applicable cancellation, refund or service-quality rights. ATA does not apply a blanket “no refunds” rule. Mandatory consumer protections take precedence over any conflicting purchase term, and any applicable statutory cancellation right remains available.

Where a course is cancelled and refunded in full, ATA withdraws access to that purchase. Access to unrelated purchases is unaffected. A refund normally goes to the original payer, including where someone else purchased learning for you.

3. Cooling off and early commencement

Where section 44 of the Electronic Communications and Transactions Act applies to your service purchase, you may cancel without giving a reason and without penalty within seven days after the agreement is concluded. A qualifying refund must be made within 30 days of cancellation.

Statutory exceptions may apply, including where a service begins with your consent during that seven-day period. ATA will assess the applicable law and evidence before relying on an exception. Issuing login details, accepting payment or starting an access-expiry clock is not treated by ATA as automatic proof that you consented to lose a cooling-off right. Any early-start choice must clearly explain its effect. Starting a course does not remove rights concerning deficient service or non-delivery.

The cooling-off period, where applicable, is separate from the learning-access period. The access periods are 90 days for a skill, 180 days for a stage and 365 days for the complete Method, beginning when the purchased learning is first opened as described in the Shop and Fulfilment Policy. Those periods are not refund-request windows.

4. Switching an incorrectly purchased skill

If you bought the wrong individual skill and have not started it, ATA allows you to switch to another available skill at the same price. Email admin@atatrainingacademy.co.za with your order reference and preferred replacement before opening the original skill’s learning content or starting its assessment. Logging into your account alone does not count as starting the skill.

ATA will check the order and learning record, replace access and confirm the change. There is no additional course fee for this equal-price switch. The replacement skill’s 90-day period begins when you first open it. This arrangement does not automatically permit substitutions within a stage or the complete Method and does not replace a statutory refund right.

5. Failed access incorrect supply and service quality

ATA’s delivery commitment is access within 2–4 working hours after confirmed successful payment. Working hours are Monday–Friday, 08:00–16:00 South African time, excluding public holidays. If access is late, incorrect or unusable, contact us promptly. You do not need to pay again to obtain access already purchased.

We will investigate the problem and explain the available remedy. Where the Consumer Protection Act’s service-quality provisions apply, you may require the defect to be remedied or a reasonable portion of the price to be refunded, taking account of the failure. Depending on the circumstances, restoration of access, correction, a reasonable extension or a refund may be appropriate. We will not impose store credit where a refund is due.

Where applicable, failure to execute an order within the agreed period may entitle you to cancel on seven days’ written notice under section 46 of the Electronic Communications and Transactions Act. If the purchased service is unavailable, ATA will notify you and make the refund within the applicable statutory period. Other applicable remedies remain available.

6. Other cancellations and bundle refunds

Outside an applicable cooling-off or other statutory entitlement, a change-of-mind request is assessed individually against the disclosed purchase terms and service provided. This policy does not promise an unconditional refund after learning has begun. Not completing the course, failing an assessment or not obtaining employment does not by itself establish a failure by ATA; any separate service defect or legal entitlement will still be considered.

For a partially used stage or complete Method, ATA will explain any lawful partial-refund calculation, considering what was delivered and the extent of any failure. We will not retrospectively inflate completed components’ prices to eliminate a refund. Where the law requires a whole-purchase remedy, that remedy will be honoured. Any unused-access or expiry issue is assessed on its facts rather than automatically treated as forfeiture of all rights.

7. Requests and response times

Email admin@atatrainingacademy.co.za with your name, order reference, purchase date, product and requested remedy. Explain an access or quality problem sufficiently for us to investigate; no reason is required for an applicable no-reason cooling-off cancellation. Call (065) 752-9651 if you need help submitting your request. Do not send card security details or passwords.

ATA will acknowledge your request within two working days and provide a decision or progress update within five working days of receiving it. Working days exclude weekends and South African public holidays. A progress update is not a final decision; if more investigation is needed, we will explain what remains outstanding and the next expected update. These service commitments do not extend statutory deadlines.

8. Payment of refunds and review

ATA will confirm the refund amount, basis and processing arrangements. Refunds are normally returned to the original payment method and payer. If that is not possible, we will verify an appropriate alternative. Any applicable legal refund deadline must be met; our internal assessment cannot postpone the start of a statutory deadline. We will explain any bank processing time and provide confirmation of processing.

Confirmed duplicate payments will be reconciled and the excess returned. We will not deduct an administration or payment-provider fee where this would undermine a statutory refund entitlement. If a request is refused or only partly accepted, we will give reasons. You may request management review through admin@atatrainingacademy.co.za without losing access to an appropriate regulator, ombud or court.
